Lady Hale speaks utter sense on Article 50 and Brexit

 

Lady Hale is far from perfect. She supported the super-injunction that keeps the antics of the titleless spouse of a loathesome gay pop singer in an olive oil filled paddling pool out of the media but in comments this week, she spoke utter sense.

 

Speaking ahead of the appeal hearing against Gina Miller’s successful challenge to Article 50, Baroness Hale stated that it is of “fundamental constitutional importance” and added: “As is well known, the referendum on whether the United Kingdom should leave or remain in the European Union produced a majority of 51.8 per cent in favour of leaving. But that referendum was not legally binding on Parliament”.

 

She continued: “Perhaps significantly, the Government has given up the argument that the issue is not justiciable in our courts” and thus annoyed the likes of the Daily Mail’s Stephen Glover. In response, he ranted: “She is presumably proud of what she said. I don’t believe she should be. In fact, it seems to me that her speech raises questions about impartiality. The timing of her intervention betrays poor judgment”.

 

“For Justice Hale has effectively thrown a boulder into the pond which cannot be removed”.

 

We hope Lady Hale throws a few more boulders and that others follow her lead.
